Employment Practices Liability (EPL) claims continue to evolve in frequency, severity, and complexity. This course provides an overview of the major employment-related exposures facing organizations today, including discrimination, harassment, retaliation, wage and hour claims, privacy issues, biometric liability, artificial intelligence in employment decisions, workplace accommodations, and emerging employment litigation trends.
Participants will learn how EPL claims arise, why defense costs continue to escalate, how recent legal developments are affecting employers, and why policy forms and coverage provisions vary significantly among insurers. The course also examines current litigation trends, underwriting considerations, and key coverage provisions that should be reviewed when evaluating EPLI policies.
Course Objectives
Upon completion of this course, participants will be able to:
- Identify the primary employment practices liability exposures faced by employers.
- Recognize emerging EPL risks, including AI, biometric privacy, workplace monitoring, accommodation obligations, and immigration-related claims.
- Explain current employment litigation trends and factors contributing to increasing EPL claim severity.
- Understand the relationship between employment practices claims, workers compensation claims, and accommodation obligations.
- Evaluate key EPLI coverage provisions and recognize material differences between policy forms.
- Identify underwriting considerations and risk management practices that can reduce EPL exposures.
